DMCA Policy
Building Status NYC respects intellectual property rights. If you believe content posted on our service infringes your copyright, send a written notice to our Designated Agent following the procedures below.
This policy is intended to comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

How to submit a takedown notice
Under 17 U.S.C. § 512(c)(3), your written notice to our Designated Agent must include all of the following:
- A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).
- Identification of the material you claim is infringing, with enough detail for us to locate it — include the URL on our service.
- Your contact information — name, address, telephone number, and email.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Notices that are incomplete or that we in good faith believe are submitted in bad faith may be rejected.
What we do after receiving a valid notice
- We remove or disable access to the challenged material.
- We notify the user who posted the material, giving them the notice (redacted of personal information where appropriate) and informing them of the takedown.
- We record the notice in our internal log for repeat-infringer tracking.
Counter-notice
If you are the user whose content was taken down and you believe the takedown was a mistake or misidentification, you may send a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, any judicial district where Building Status NYC may be found), and that you will accept service of process from the person who submitted the original DMCA notice.

If we receive a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 to 14 business days that they have filed a court action seeking a restraining order against you, we will restore the material.
Repeat infringers
We terminate accounts of users who we determine are repeat infringers of copyright. A "repeat infringer" in our system is any account with two or more unresolved takedown notices within a rolling twelve-month period, or a single determination by a court of copyright infringement. We may terminate on first notice if the infringement is egregious.
Terminated users may not create new accounts without our written consent.
Safe harbor
By maintaining this policy and acting on properly submitted notices, we seek protection under the DMCA safe harbor, 17 U.S.C. § 512. Nothing in this policy limits any right or defense we have under law.
Misuse of the DMCA
Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing (or that it was removed by mistake) can subject you to liability for damages, including costs and attorneys' fees. File your notice or counter-notice in good faith.
